CookOrBit’s aggregate liability for direct damages for any claim arising out of or relating to these Terms shall not exceed the fees paid by you to CookOrBit in the six (6) months preceding the claim, or one hundred U.S. dollars (USD 100) if no fees were paid.
Indemnification
You agree to indemnify, defend, and hold harmless CookOrBit and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any third-party rights.
Termination
CookOrBit may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms, with or without notice. Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which CookOrBit is established, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved by the courts of that jurisdiction, unless otherwise agreed in writing. If you are a consumer in a jurisdiction that requires different dispute resolution mechanisms, those local rules may apply.
Modifications to the Terms
CookOrBit may modify these Terms at any time. When changes are made, CookOrBit will post the updated Terms on the Site with a revised effective date. Your continued use of the Site after posting constitutes your acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
