DMCA Policy and Copyright Infringement Notification Procedure

How to Submit a DMCA Takedown Notice

  • Physical or electronic signature: The notice must be signed physically or electronically by the copyright owner or a person authorized to act on the owner’s behalf. A typed name at the end of an emailed notice is acceptable.
  • Identification of the copyrighted work: Provide a clear description of the copyrighted work you claim has been infringed (title, author, registration number if available).
  • Identification of the infringing material: Provide a specific description of the allegedly infringing material and its exact location on the site (URL(s) or other specific location information) so we can locate the material.
  • Contact information: Provide your name, mailing address, telephone number, and email address so we can contact you if needed.
  • Good faith statement: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy and penalty of perjury: Include a statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.

Send the notice to [email protected]. We may request additional information to verify the claim. Failure to provide required elements may result in delayed or rejected processing.

Processing and Response

  • We will acknowledge receipt of your notice by email when possible.
  • Upon receipt of a compliant notice, we will act expeditiously to remove or disable access to the allegedly infringing material.
  • We may forward the notice to the affected user, account holder, or third parties (e.g., hosting providers, ad networks including Google AdSense or Ezoic) as necessary to enforce copyright policies and to comply with contractual obligations.
  • We may retain a copy of the notice and related correspondence in our records for enforcement and reporting purposes.
  • We do not provide legal advice. If you are unsure whether material infringes your copyright, you should contact an attorney.

Counter‑Notice Procedure

If you believe that material removed or disabled as a result of a DMCA notice was removed in error or is misidentified, you may submit a counter‑notice. To be effective, a counter‑notice must include the following elements:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where the material appeared before removal (URL or other specific location information).
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, mailing address, telephone number, and email address, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are located outside the United States, consenting to the jurisdiction of any judicial district in which CookOrBit may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  • A statement that you agree to indemnify CookOrBit for any costs or damages incurred as a result of a bad‑faith counter‑notice, if applicable.

Submit counter‑notices to [email protected]. If a valid counter‑notice is received, we may reinstate the material within a reasonable time frame, typically after 10–14 business days, unless the original complainant files an action seeking a court order to restrain the allegedly infringing activity.

Repeat Infringer Policy

CookOrBit reserves the right to terminate, suspend, or restrict access to any user account or service that is determined to be a repeat infringer in appropriate circumstances. A repeat infringer is any user who has multiple valid copyright infringement notices or who has engaged in a pattern of infringing activity. We will also take reasonable steps to prevent access to material posted by repeat infringers, which may include removing content and/or restricting accounts.

Third‑Party Advertising, Cookies, and Tracking

CookOrBit displays third‑party advertising, including programmatic ads served by networks such as Google AdSense and ad mediation platforms such as Ezoic. These third‑party vendors may use cookies, web beacons, device identifiers, and similar technologies to collect information about your interactions with ads and content, to measure ad performance, to personalize advertising, and for analytics purposes.

  • CookOrBit is not a law enforcement agency. We do not provide legal advice and we are not responsible for the accuracy of statements made by claimants or respondents.

  • All remedies available under law are reserved. Submission of a DMCA notice does not guarantee removal in every case; we reserve the right to evaluate notices for compliance with law and this policy.
